An uncontested divorce can save the divorcing couples time, money and acrimony and can be an option to consider in certain circumstances.
An uncontested divorce can be a divorce option to consider when the divorcing spouse do not have any remaining disagreements between them concerning divorce-related issues and have agreed to those issues between themselves. Divorce-related issues concerning child custody, child support, spousal support and property division all must be resolved for an uncontested divorce.
If the couple has unresolved concerns, on the other hand, the divorce is considered contested and the family law process can help the divorcing spouses resolve those concerns. For a divorce to be considered uncontested, both spouses must agree to the divorce. If one of the spouses contests the divorce, then the divorce cannot go through the more streamlined divorce process associated with an uncontested divorce. Uncontested divorces may not be best in situations when the divorcing couple has complex property or child custody issues and in some circumstances when a child is involved.
An uncontested divorce can offer a variety of benefits, however, in addition to being lower conflict and saving on time and money, including offering greater privacy to the divorcing couple because there will be fewer public filings that are part of the divorce proceeding. Divorce is a big step for many couples which is why they should understand all the different options available.
